Spotify Partner Program Terms

Effective Date: January 2, 2025

  1. Introduction: By opting in to the Spotify Partner Program (“Program”) on the Spotify for Creators platform (“Platform”), you agree to be bound by these terms (“Program Terms”). These Program Terms are entered into between you, and Spotify USA Inc., a Delaware Corporation with offices at 4 World Trade Center, 150 Greenwich Street, 62nd Floor, New York, New York 10007 and Spotify AB, of Regeringsgatan 19, 111 53 Stockholm, Sweden, with registered number 556703-7495 (together, as applicable, “Spotify”). The Program Terms incorporate the Spotify for Creators Platform Terms and Conditions of Use (“Platform Terms”) (together, the Program Terms and the Platform Terms are the “Terms”). Capitalized terms not otherwise defined herein shall have the meaning given to such terms in the Platform Terms. In the event of a conflict between the Platform Terms and these Program Terms, these Program Terms will control with respect to the Program. The Terms represent the entire agreement between Spotify and you with respect to the Program and replace any prior or current terms regarding the Program and any subject matter contained in these Program Terms.
  2. Eligibility: You must be at least 18 years old to participate in the Program, or you must have a parent or guardian that meets the minimum age requirements responsible for your payouts via Spotify Payouts. If you have been given access to and you enter into the Program, you may be eligible to monetize your User Content via the Program, as described on the Platform. You must meet (and continue to meet) all eligibility and other criteria for participation in the Program, as determined by Spotify, and complete onboarding into the Program, including providing the tax documentation as required by Spotify. This criteria and your ability to monetize via the Program may change at any time in accordance with these Program Terms. By participating in the Program, you represent and warrant that you have linked your Spotify for Creators account with your Spotify account and a valid Spotify Payouts account. Your payment may be withheld or delayed if you do not maintain accurate contact and payment information.
  3. License: Without limiting the license granted under the Platform Terms, you acknowledge that by participating in the Program, you grant Spotify the right to place and sell advertising within your Monetized Content, including alongside any advertising already embedded within your Monetized Content.
  4. Earnings: When you participate in the Program, you can earn revenue from Spotify i) if your legal address is in a country where the Program is available (as listed here) (each, an “Eligible Country”), for video streaming of your Monetized Content by Spotify Premium users in each Eligible Country (“Premium Video Revenue”); and ii) for ads inserted by Spotify into your Monetized Content as part of the Program (“Ads Revenue”) when consumed wherever Premium Video Revenue is not available. Earnings for Ads Revenue are calculated based on a share of revenue recognized by Spotify in accordance with generally accepted accounting principles (either US GAAP or IFRS) for advertising impressions delivered directly against your Monetized Content as part of the Program. Earnings for Premium Video Revenue are funded by Spotify based on the share of video streaming on Spotify Premium across each Eligible Country that is recognized by Spotify and attributed to your Monetized Content. Spotify may add or remove countries on the Eligible Country list and adjust how earnings are calculated from time to time in accordance with these Program Terms. Without limiting anything in the Terms or Spotify’s other remedies, Spotify may exclude from this calculation any Invalid Activity (defined below) detected by Spotify. Adjustments to earnings may occur after payout and may be incorporated in subsequent payouts.We may provide you with regular reporting in connection with your participation in the Program. You acknowledge that such data is provided “as is”, and Spotify does not guarantee that such data will be available error-free or the final amount payable. Your payouts will be displayed in your Spotify Payouts account dashboard as described in Section 5 below.Without limiting anything in the Platform Terms or the Spotify Payouts Terms, if Spotify reasonably suspects abuse of its Monetization Services or detects any activity indicating artificially altered download or streaming metrics of your User Content as measured by Spotify, including but not limited to any unnatural impressions generated by any person, bot, script or other automated or manual means, impressions generated from payment or other inducement, misrepresentation such as content exhibiting deceptive or manipulative naming, design, formatting, or metadata, or activity that is otherwise in violation of the Terms (including impressions co-mingled with any of the foregoing activity) (“Invalid Activity”), Spotify may withhold payment for any such Invalid Activity. In respect of your Invalid Activity, Spotify may also collect amounts previously paid to you that are associated with such Invalid Activity. Payment may be delayed while Spotify is investigating Invalid Activity. If Spotify’s investigation ascertains that there is no Invalid Activity, then Spotify will resume payment.
  5. Account with Spotify Payouts: In order to participate in the Program, you will be required to link a valid Spotify Payouts account at https://payments.spotify.com/payouts. Your use of Spotify Payouts, including any payments, will be subject to the Spotify Payouts Terms. You agree to comply with the Spotify Payouts Terms and not to participate in the Program for any activity that is expressly prohibited or restricted by those terms. Spotify may suspend or terminate the provision of the Spotify Payouts services to you if you do not comply with the Spotify Payouts Terms.
  6. Fees and taxes: Your earnings balance may be subject to transactional fees, including without limitation fees imposed by Spotify Payouts as set out under the Spotify Payouts Terms, and any additional fees as disclosed to you. Additionally, taxes may apply and you may be required to provide certain information as a result, please refer to the Spotify Payouts Terms for details.
  7. Acknowledgements: You represent, warrant and acknowledge that:
    1. You have the power and authority to enter a binding contract with us and are not barred from doing so under any applicable laws;
    2. You will comply with all applicable laws and regulations and Spotify’s Monetization Policies when participating in the Program;
    3. Any registration information that you submit to Spotify is true, accurate, and complete;
    4. Spotify is not responsible for and does not guarantee any consumption of your Monetized Content or that any earnings will be generated from your participation in the Program;
    5. Spotify shall have exclusive right to sell advertising inserted into your User Content dynamically including via streaming ad insertion, but as part of the Program, Spotify will not sell dynamically inserted advertising into the video stream of your Monetized Content on Spotify Premium in each Eligible Country;
    6. You are responsible for inserting ad breaks into your Monetized Content as appropriate;
    7. Spotify may provide tools to help support specific ad category exclusions, as described on the Platform, provided that you input appropriate tags into the system, but Spotify does not guarantee that excluded categories of ads will not run. You will not otherwise have the ability to review or pre-approve the advertising creative or any other deal details of any ads before they run;
    8. You will not (i) make any of your User Content available for monetization if it is directed to children as defined by applicable law (even if children are not the primary audience for such content); or (ii) otherwise share or make available to Spotify information about children as defined by applicable law in connection with the monetization of your User Content; and
    9. You will not engage in Invalid Activity.
  8. Termination: Spotify may suspend or terminate your access to the Program (including for some or all of your Monetized Content) and terminate these Program Terms because of Invalid Activity or otherwise in accordance with the Platform Terms. Additionally, subject to applicable law, Spotify may terminate your access to the Program and terminate these Program Terms at any time upon thirty (30) days’ written notice.These Program Terms will terminate automatically upon termination of the Platform Terms.You may also terminate these Program Terms and your access to the Program at any time by contacting us via our help page.
  9. Changes: The Program and its availability may change from time to time. Spotify will notify you of any changes to what we have communicated to you about the Program by any reasonable means, including by posting the update to the Platform (provided that, for material changes, we will seek to supplement such notice by email, an in-service message, or other means, thirty (30) days in advance). Your continued participation in the Program will constitute your acceptance of such changes. Spotify may otherwise make changes to these Program Terms in accordance with the Platform Terms.
